After graduating from the University of Texas and the Baylor School of Law, Mr. Kinsel clerked for the Honorable Thad Heartfield, Chief Judge of the United States District Courts for the Eastern District of Texas. Since entering private practice, Mr. Kinsel has been actively involved in trials, mediations and arbitrations throughout the United States, representing victims of the negligent and intentional acts of others. He has handled a vast array of legal matters and has personally tried cases involving products liability, negligence, admiralty, and gross negligence. Mr. Kinsel has also been actively involved in cases pending in the Courts of Panama, Honduras, Guatemala and Nicaragua. Mr. Kinsel is a partner at Moore Landrey, LLP. Mr. Kinsel, co-counsel, successfully briefed and argued to the United States Ninth Circuit Court of Appeals in Abrego v. The Dow Chemical Corporation that a federal district court in California did not have jurisdiction pursuant to the Class Action Fairness Act based on diversity of citizenship and, as a result, an order remanding over 1000 Panamanian banana plantation workers' cases to state court was affirmed. The Abrego decision is the first by a United States Circuit Court that interprets CAFA's burden of proof, the amount in controversy requirement and the discretion district courts are given to authorize jurisdictional discovery.
